Less Than Four Months Remaining! New Mandatory ANATEL Certification Rules for Communication and Energy Storage Lithium Batteries – Full Guide to Customs Clearance Requirements

On April 14, 2026, Brazil’s National Telecommunications Agency (ANATEL) officially issued Decree Ato nº 5314/2026, which formally includes stationary lithium batteries for communication applications in the mandatory certification control list. The regulation will be fully and strictly enforced starting October 12, 2026.

With less than four months until policy implementation, all base station energy storage batteries, communication backup power supplies and lithium batteries supporting UPS exported to Brazil will be blocked from customs clearance and banned from local sales without valid ANATEL mandatory certification. Relevant export enterprises shall immediately launch certification preparation to avoid risks such as cargo detention at ports and order breach of contract.

I. Products Required to Apply for Mandatory ANATEL Certification

(1) Four Mandatory Product Access Criteria (All must be met simultaneously)

Lithium battery products fall under this round of mandatory control only if they satisfy all the following requirements at the same time:

1、Product structure: Stationary lithium batteries equipped with a complete built-in BMS (Battery Management System) monitoring and protection system;

2、Rated voltage: 24 VDC / 48 VDC;

3、Service life: Designed service life ≥ 10 years under 25 ℃ floating charge environment;

4、Application scenario: Specially designed to provide main power supply or backup energy storage for telecommunication equipment, suitable for medium and high discharge working conditions.

(2) Eligibility Requirement for Certificate Holders

Overseas factories and Chinese export enterprises are not accepted as ANATEL certificate holders. The certificate must be held by a local Brazilian entity, only including local importers and domestic distributors in Brazil. Export enterprises need to lock in compliant Brazilian partners in advance and reserve sufficient docking time to avoid certification stagnation.

II. Core Technical Standard System

All testing activities can only be carried out by third-party laboratories with official ANATEL recognition. The standard system consists of two sets: Brazilian national standards and supplementary IEC international standards.

(1)Mandatory Brazilian National Standards

1、ABNT NBR 16975:2021: Electrical performance specifications and complete test methods for stationary lithium batteries

2、ABNT NBR 16976:2021: Safety specifications and reliability test requirements for stationary lithium batteries

(2)Supplementary IEC Supporting Test Standards

Covers all dimensions including EMC (Electromagnetic Compatibility), functional safety and industrial lithium battery safety: electrostatic immunity, electrical fast transient burst, surge immunity testing, IEC 61508 functional safety, IEC 62619, IEC 62629 industrial lithium battery safety testing.

*Hard Requirement for BMS Communication (Test will be rejected directly if unqualified): BMS is a standard mandatory component and cannot be omitted. Products must be equipped with the MODBUS communication protocol, and the device shall upload all operating data in real time and completely: single cell / pack voltage, battery temperature, SOC (State of Charge), SOH (State of Health) and fault alarm signals. Failed communication performance will result in an overall failure of the whole machine test.

III. Sample Regulations and Complete Test Items

(1)、Detailed Control Rules for Test Samples

Samples are divided into 7 test groups with 1 sample per group, covering three test modules: preliminary evaluation, electrical performance and safety.

1、Constant temperature test environment: 25 ± 3 ℃;

2、Sample restriction: All samples shall be from the same production batch, with a production date no more than 6 months prior to testing;

3、Failure tolerance mechanism: A maximum of 2 replacement samples are allowed for a single failed test. If three consecutive tests still fail, the enterprise shall resubmit the certification application.

(2)、Two Major Categories of Test Items

1、Electrical Performance Test: Capacity calibration, low-temperature discharge performance, high-current discharge test, charge-discharge cycle durability, internal resistance detection of batteries.

2、Safety and Reliability Verification: Drop mechanical test, overvoltage / overcurrent / overtemperature protection verification, full-set EMC immunity test, thermal runaway chain suppression test to eliminate the risk of pack fire caused by single cell failure.

IV. Compliance Specifications for Product Markings and Technical Documents

(1)、Mandatory Permanent Markings on Product Housings

Three types of permanent marks must be clearly printed on the product casing. Missing any single mark will result in the product being judged non-compliant:

1、Official ANATEL certification stamp;

2、Homogenized family model number (unified mark for series certified products);

3、Battery waste disposal mark required by Brazilian solid waste regulations.

(2)、Full Set of Technical Manuals in Portuguese Version

Manuals shall fully cover product specifications, installation & operation guidelines, operation & maintenance instructions, safety codes, storage & transportation requirements and after-sales contact channels for reference by local Brazilian distributors and field maintenance personnel.

V. Certificate Maintenance and Annual Audit Rules

Certificates are issued based on type testing and are not lifelong valid. Regular reviews are required to maintain certification eligibility.

Basic Review Cycle

A product consistency and production system review is conducted every 3 years. The full compliance lifecycle lasts 9 years, divided into three review phases:

1、Phase M1 (3 years after certification issuance): Retest Group 1 and Group 2 samples;

2、Phase M2 (6 years after certification issuance): Retest Group 2 and Group 5 samples;

3、Phase M3 (9 years after certification issuance): Full comprehensive re-test of all items.

*Mandatory Supporting Environmental Compliance Requirement: This decree is bound to Brazil’s solid waste management policy simultaneously, and environmental compliance is incorporated into mandatory certification audits. Enterprises must provide harmless recycling and disposal schemes for waste batteries, as well as prevention and control measures for electrolyte and heavy metal pollution. Certification will not be approved if environmental requirements cannot be met.

Compliance is never trivial, and certification preparation should start early! Enterprises that have not yet launched ANATEL certification planning shall arrange testing and document preparation as soon as possible to avoid customs clearance blockage and cargo detention risks, and firmly secure export market share of communication lithium batteries in Brazil.
