On October 12, 2022, California, the United States, issued two "60 day violation notices" based on California Proposition 65 for bisphenol A (BPA). These violation notices involved sports bras and sweatshirts sold by more than ten brands, retailers or manufacturers.
Bisphenol A (BPA, CAS No. 80-05-7) is a chemical substance known to cause reproductive toxicity, and has been included in the chemical substance list of California Proposition 65 since May 2015. BPA is widely used to make polycarbonate plastic, PVC, epoxy resin and thermal paper. In addition, BPA can be used as a color fixing agent for polyester and polyamide textiles, and can be used in the production of spandex to improve the antistatic performance of spandex.
The "60 Day Notice of Violation" is a legal document used by interested parties (retailers, brands, manufacturers or distributors, etc.) who put products into the California market to inform them that they have violated the requirements of California Proposition 65. Generally speaking, "60 day notice of violation" will trigger negotiations and reach a lawsuit or settlement agreement.
About California Proposition 65
California Proposal 65 (CA65 for short) can also be called CP65 certification or Prop65 certification. The Chinese name is the Safe Drinking Water and Toxic Substances Enforcement Act of 1986, which came into force in November 1986.
California Proposition 65 covers almost all consumer goods in life, including textiles, metal products, toys, youth products and electrical/electronic products. When the product is put on the California market, the enterprise must comply with the California 65 standard, and if the harmful substances in the product reach the level of exposure that triggers the warning requirements, the enterprise must affix a warning sign, otherwise it will face litigation and thus generate a fine of not more than 2500 dollars per day for each violation.
