On December 31, 2024, the official gazette of the European Union officially issued the BPA ban (EU) 2024/3190, which requires further revision of the plastic regulation (EU)No 10/2011 and the abolition of (EU)2018/213, and will take effect on January 20, 2025. The release of the ban marks a total ban on the use of bisphenol A in the European Union and member countries, and its influence is extremely wide, involving many related fields and enterprises. Relevant enterprises need to prepare in advance!

Prohibition requirements for bisphenol A

A(Bisphenol A (abbreviated as BPA, CAS No.80-05-7) has many dangerous characteristics, such as reproductive toxicity, damage to children's health, hormone-like effects and so on. According to the latest opinion of bisphenol A released by the European Food Safety Agency (EFSA) in April 2023, it is unsafe to be exposed to bisphenol A in the diet, and the daily tolerable intake (TDI) is 0.2ng/kg body weight, which is 20,000 times lower than the evaluation opinion in 2015. Based on EFSA's assessment, the European Commission has formulated a ban on bisphenol A to protect public health.

◆ It is forbidden to use bisphenol A and its salts in the manufacture of adhesives, rubber, ion exchange resins, plastics, printing ink, silica gel, varnishes and coatings for food contact materials, and it is forbidden to put food contact materials and products made of bisphenol A on the EU market.

◆ It is forbidden to use bisphenol or bisphenol derivatives other than BPA for the manufacture and sale of FCM, and BPA shall not remain unless authorized.

◆ Specific exemption of BPA

Revision (EU)No 10/2011

◆ In Article 6 "Exemption of substances not included in the EU list", the following contents are added:

As a partial exemption from Article 5, "bisphenol A" or "BPA" (CAS: 80-05-7) and other harmful bisphenol or its derivatives defined in the proposal can only be used to manufacture plastic materials and products that meet the requirements of the proposal (that is, the exemption requirements in Appendix II).

◆ Delete contents: the entries of substance BPA No.151 and substance BPS No.154 (CAS: 80-09-1) in Table 1 of Appendix I of (EU) No.10/2011.

Provisions on the transition period

★ Disposable food contact materials and products

◆ The sales period of one-off FCM products is until July 20, 2026.

◆ The sales period of special products is until January 20, 2028, mainly including the following categories:

1. Used for preserving vegetables or fruits, excluding products (13) defined in Annex I of Council Directive 2001/112/EC;

2. Aquatic products as defined in Regulation (EC) No.853/2004 of the European Parliament and Council (14);

3, only the outer surface of the metal is coated with bisphenol A to make varnish or coating.

★ Repetitive food contact materials and products

◆ Repeatable FCM products will be put on the market for the first time until July 20, 2026.

◆ If it is a reusable food contact article used by professional food production equipment and meets the applicable rules before the effective date of these Regulations, it can be put on the market for the first time until January 20, 2028.

◆ In addition, the reusable food contact materials and products put on the market for the first time in the above two cases can be kept in the market until January 20, 2029 at the latest.
