New FCC regulations in the United States: Since February 6, 2023, the application for FCC ID certification requires the provision of local agent information in the United States

On February 6, 2023, The FCC of the United States officially issued the updated document DA/FCC No.: FCC-22-84 "Protection of the communication supply chain from national security threats through the equipment authorization plan" (47 CFR Parts 2 and 15 ET Docket No. 21-232 and EA Docket No. 21-233], which will take effect immediately from the date of release, without a transition period. This document is mainly about the FCC's protection of the communication supply chain from national security threats through the equipment authorization plan, thus limiting the contents and equipment on the Covered List.

Important updates

In this document, the FCC amended the equipment authorization rules to further protect the communication network and supply chain of the United States from the impact of equipment that poses an unacceptable risk to the national security of the United States or the security of Americans. At present, the United States Congress has determined the equipment listed on the Covered List within one year after the promulgation of the Safety Equipment Act of 2021. This list will be updated regularly. Based on the judgment that the equipment poses an unacceptable risk to national security, such equipment can be added to the Covered List.

Sections 2.903 and 2.911 (d) (5) of the FCC Regulation will also be issued, and corresponding document requirements will be added. According to the further description of KDB 986446 D01, for all new authorizations, the applicant needs to provide the following two statements:

1. The applicant or the product applied for is not a statement restricted on the prohibition list.

2. The local agent "Attention Statements" certifies the statement and meets the following requirements:

◆ Both the applicant and the local agent sign;

◆ The applicant has the obligation to express the will of the agent and appoint the local agent to accept the service of the summons;

◆ Provide the agent's local address and e-mail address in the United States;

◆ The applicant shall ensure that after the termination of all sales and import of its products or the completion of any relevant FCC procedures involving the equipment, it still maintains the obligation of its local agent for not less than one year.

From February 6, 2023, the above new documents must be submitted to the FCC at the same time as the new application materials.

1. When did you start to force the FCC certification to provide the American agent?

From February 6, 2023, all wireless communication products exported to the United States for FCC-ID certification need the information of the United States agent, except for those whose applicants are American companies.

2. How to classify the FCC IDs applied before February 6, 2023?

Applicants who have not yet issued the certificate before February 6, 2023 need to fill in the relevant information of the United States Agency. Even those who issued the certificate on the same day, if there is no United States Agency, they need to fill in the United States Agency; If the applicant has issued the certificate before February 6, 2023, it may not need to supplement the information of the US agent.
