Attention! US Congress passes bill on danger of coin/coin cell ingestion

On August 11, 2022, the U.S. Congress passed the H.R. 5313 Reese Act. This is a consumer product safety standard regarding the ingestion hazards of button or coin cells.

Not later than 1 year from the date of enactment of this Act, the U.S. Consumer Product Safety Commission (CPSC) will promulgate consumer product safety standards for button or coin batteries, including:

◆ A performance standard to reduce the risk of injury for button or coin cells or consumer products containing button or coin cells.

◆ Warning labels should clearly identify the hazard of ingestion and instruct consumers to keep new and used batteries out of the reach of children, to seek immediate medical attention if batteries are ingested, and to follow any other consistent medical advice.

◆ Warning statements should be placed next to the product's packaging, instructions and battery compartment.

◆ Within 180 days of the enactment of this Act, any button/coin cell battery or button/coin cell battery contained separately in a consumer product shall be packaged in "toxic packaging" in accordance with 16 CFR 1700.15.

Toy products should be exempt from the above requirements because toys are regulated under 16 CFR 1250 and have associated requirements.

Definition of Batteries and Consumer Products Containing Batteries

1. Definition of button battery or coin battery

● A single battery whose diameter is greater than the height of the battery;

● any other batteries that present an ingestion hazard

2. Definition of Consumer Goods Containing Batteries

Consumer products that contain or are designed to use one or more coin cell batteries, whether such batteries are intended to be replaced by the consumer, or included in the product or sold separately.
