Important hint! UK to amend the Toys (Safety) Regulations 2011

In April 2022, the UK issued a proposed regulation, The Toys and Cosmetic Products (Restriction of Chemical Substances) Regulations 2022 (hereinafter referred to as the "proposal"), to amend the Toys (Safety ) Regulations 2011 (The Toys (Safety) Regulations 2011) (S.I. 2011 No. 1881).

The proposed amendments to the regulations on children's toys include: increasing the control requirements for aniline and formaldehyde in toys intended for use by children under 36 months of age and intended to be imported; revising the migration limit of aluminum elements; adding three new requirements for banning allergenic fragrances .

Increase the control requirements for aniline and formaldehyde in specific children's toys

It is proposed to increase the limits of aniline and formaldehyde in Appendix C of Schedule 2 of the British Toys (Safety) Regulations 2011 "Requirements for the Limits of Hazardous Chemical Substances in Toys for Children under 36 Months or Other Children's Toys Intended for Inlet". as follows:

The proposed aniline limit requirements are the same as those of European Union Directive (EU) 2021/903, and the formaldehyde limit requirements are the same as those of European Union Directive (EU) 2019/1929. Among them, the European Union Directive (EU) 2021/903 will be implemented in EU member states and Northern Ireland from December 5, 2022. Directive (EU) 2019/1929 has been implemented in EU Member States and Northern Ireland in the UK from 21 May 2021.

Revised Migration Limits for Aluminum Elements

It is proposed to revise the migration limit of aluminum element in the table of point 13 of Annex 2, Part 3 of the Toys (Safety) Regulations 2011. The proposed revision limit is as follows:

The proposed aluminium migration limit requirements are the same as those in European Union Directive (EU) 2019/1922. The EU Directive has been implemented in EU member states and Northern Ireland in the UK from May 20, 2021.

Added 3 banned allergenic fragrances

It is proposed to add 3 prohibited allergenic fragrances to the table at point 11 of Part 3 of Annex 2. The specific allergenic fragrance information is as follows:

The ban on allergenic fragrances does not apply to allergenic fragrances that are technically unavoidable under good manufacturing practice and contain no more than 100 mg/kg. The proposed addition of 3 banned allergenic fragrances is the same as the requirements of European Union Directive (EU) 2020/2089. The EU Directive will be implemented in EU member states and Northern Ireland in the UK from July 5, 2022.
